The Terms do not govern the provision of, nor constitute an offer for, any financial products or services provided by any companies within the Clear Junction Group. Accessing or utilising services from any companies within the Clear Junction Group requires entering into a separate service agreements. This process is distinct and separate from your acceptance of these Terms.
1.4. By accessing or using our Website, you confirm that you have read, understood, and agreed to be bound by these Terms. If you are using the Website on behalf of a company, or other legal entity, you represent and warrant that you are authorised to do so and have the authority to bind such entity to these Terms.
1.5. To the maximum extent permitted by applicable law, you agree that any use of the Clear Junction website establishes your consent to these Terms and serves as your binding electronic signature, indicating your intention to be legally bound by these Terms without the necessity of a physical signature or explicit clickwrap agreement.

2. Clear Junction Group
2.1. The Website provides information about the products and services provided by the companies within Clear Junction Group.
2.2. Clear Junction Group constitutes a group of companies (covered in Section 2.5 below) which focuses on the wholesale market (financial institutions and regulated companies), where it uses its systems and payment infrastructure to offer access to interbank clearing through its own BIC, issuance of virtual IBANs or B2B services. The Firm works exclusively with institutional clients including remittance companies, banks, payment services providers, card issuers and digital currency businesses.
2.3. CLEAR JUNCTION GROUP (INCLUDING ALL THE COMPANIES WITHIN THE GROUP) NEVER PROVIDES SERVICES TO INDIVIDUAL CONSUMERS AND DOES NOT ESTABLISH BUSINESS RELATIONSHIPS WITH INDIVIDUALS.
2.4. We understand there may be instances of confusion regarding the nature of services provided by the companies within Clear Junction Group. To clarify:
Target Market: Clear Junction Group’s engagement is strictly with financial institutions and regulated companies. Any direct services, products, or business relationships are conducted solely with such corporate clients, not with their individual consumers or the general public.
No Direct Individual services: Individual consumers seeking information or services must direct their inquiries or requests to the respective financial institutions they have accounts (business relationships) with. The companies within Clear Junction Group do not directly interact with or provide services to individual consumers.

Clear Junction Group adheres to the cross-cutting rules as defined under Principle 12 by the FCA, embodying the ethos of acting in good faith, preventing foreseeable harm, and enabling their clients to achieve their financial objectives. 6.3. Clear Junction Group’s services are exclusively tailored for licensed and regulated financial institutions, including banks, PSPs, money transfer businesses, and Crypto businesses. Clear Junction Group and the companies within Clear Junction Group do not provide services to individual consumers.
7. Support and Complaints Handling
7.1. At Clear Junction, we are dedicated to providing exceptional service and support to all our clients. We recognise, however, that there may be times when our service does not meet expectations. In such instances, we are committed to addressing and resolving complaints promptly, fairly, and effectively.

7.3. To facilitate a swift and effective investigation, please include as much detail as possible about your concern, including the nature of the complaint, any relevant dates, transactions, impact, desired outcome, and your contact details. Providing complete information enables us to address your complaint more efficiently.
7.4. Your complaint will be logged in our system and a designated Clear Junction team member will be allocated to handling your matter. We would like to assure you that our team members are duly experienced and will do their best to resolve your complaint. They will have the authority to settle your complaint or will have access to someone who has such authority.

We encourage individual consumers to first direct their inquiries or complaints to the respective financial institutions they have accounts (business relationships) with (this could be the bank you used to send money or the company that ultimately received the funds).

We ensure clear, supportive, and empathetic communication, with special attention to vulnerable customers, processing their complaints out of turn. Our aim is to mitigate the impact of fraud through proactive fraud alerts, responsive support services, and ensuring clients are informed about how to protect themselves against scams.

You hereby waive any objection to the exercise of jurisdiction over you by such courts and to the venue of such courts.

10.2. In these Terms, unless specified otherwise, use of the singular includes the plural, use of any gender is deemed to include every gender and any reference to a person includes a corporation, a partnership and any other body or entity, and vice versa.
10.3. Use of the words, includes or including or similar words or phrases means without limitation and the use of these or similar words or phrases shall not limit the meaning of the general words.
10.4. We shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is caused by circumstances beyond our reasonable control.
10.5. Nothing in these Terms is intended to confer on any person any right to enforce any term of these Terms which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999.
10.6. Each of the provisions of these Terms (or part of any provision) is severable. If any such provision is or becomes illegal, invalid or unenforceable in any respect under the law of any jurisdiction that shall not affect the legality, validity or enforceability of the other provisions of these Terms. The provision itself shall apply with the minimum modification necessary to make it legal, valid and enforceable.
10.7. Failure or delay by us in enforcing these Terms shall not be a waiver of that or any other provision of these Terms.
10.8. You may not assign any of your rights or obligations under these Terms.
10.9. These Terms constitute the whole agreement and understanding between you and us in relation to their subject matter and the use of our Website.
